Terms & Conditions
These Terms & Conditions apply to use of bottomsupgayboatparty.com and to tickets and reservations made through the website unless different terms are clearly stated for a particular event.
1. Who operates the website
The website and online ticket sales service are operated by Sophie Nicole Casey LLC DBA Casey Marketing Creations, 8 The Green, Suite B, Dover, Delaware 19901, United States, US EIN 32-0741556.
We refer to this company as “CMC”, “we”, “us” or “our”. CMC operates the website and acts as an authorised ticket seller, booking and marketing agent for Bottoms Up Gay Boat Party.
2. Who operates the event
The boat parties are managed and operated in Gran Canaria by Tarkan Tuna Korumaz, referred to in these Terms as the “Event Provider”.
CMC does not own or operate the vessel and does not act as the vessel’s skipper, crew, transport provider, water-sports operator or insurer. Unless otherwise expressly stated, when you reserve a place through us, CMC arranges the booking as an authorised seller on behalf of the Event Provider.
The Event Provider is responsible for operation and delivery of the cruise itself, including the vessel, crew, route, operational safety, onboard service and event management. CMC remains responsible for its own obligations relating to operation of the website, administration of bookings and payments received by CMC, customer service and other services CMC directly provides.
3. Age requirement
18+ events
Bottoms Up boat party events are for adults aged 18 and over only. By booking, you confirm that you and every person included in your booking meet the minimum age requirement. Proof of age may be requested.
A person who cannot demonstrate that they meet the age requirement may be refused participation where appropriate.
4. Event information
Event dates, prices, meeting points, meeting times, ticket inclusions and other event-specific information are shown on the relevant event or product page and/or your ticket or booking confirmation.
Weekly events, Summer events, GayPride and WinterPride events may have different arrangements. You must therefore check the information relating specifically to the event you book.
Your ticket or booking confirmation should be treated as the final source for your event’s meeting time and meeting point where it differs from general information elsewhere on the website.
5. Booking process
Where online checkout is available, you select the event and ticket, provide the requested booking information, review the order and submit the required payment. A booking is accepted when confirmation is issued to you, subject to availability and successful payment.
The electronic booking record may be retained in our systems. If you have an account, certain booking information may also be available through the My Account area.
You are responsible for reviewing the information entered before submitting your order. If you discover an error after booking, contact us as soon as possible.
Bookings may also be arranged directly with the Event Provider through WhatsApp, Messenger or another communication channel linked from the website. A booking made directly with him is subject to his confirmation and may involve third-party communication platforms.
The primary language of the online booking process and these Terms is English unless otherwise stated.
6. Prices, deposits and balances
The current price for an event is the price displayed on the relevant product or event page at the time you book. Different events may have different prices, deposits and balances.
Some bookings require only a reservation payment or deposit online, with the remaining balance payable at the meeting point or as otherwise stated in the booking information. Any outstanding balance must be paid as instructed in the booking confirmation.
Prices and advertised inclusions apply to the specific event selected.
If an obvious pricing or technical error occurs, we may contact you before confirming or fulfilling the booking and offer you the opportunity to proceed at the correct price or receive a refund of any amount already paid.
7. Payment processing
Online payments are processed through third-party payment providers made available at checkout and are subject to the payment provider’s own terms. A booking is not confirmed merely because a payment attempt has been initiated; payment must be successfully authorised and the booking confirmed.
8. No general 14-day cooling-off period
Tickets are sold for leisure activities taking place on a specific date or during a specific period. The statutory 14-day withdrawal or cooling-off right that applies to many online purchases does not generally apply to this type of dated leisure booking where the relevant consumer-law exception applies.
Your cancellation rights are therefore determined by these Terms, Part 4 of this document (the Cancellation & Refund Policy) and any mandatory consumer rights that cannot legally be excluded.
9. Cancellations and refunds
The Cancellation & Refund Policy in Part 4 forms part of these Terms and is the authoritative policy for cancellations, credits, transfers and refunds.
In summary: customer cancellations notified at least 72 hours before the event may qualify for a future-event credit rather than a cash refund; later cancellations and no-shows normally lose the deposit or reservation payment; and where the event itself is cancelled by us or the Event Provider, a refund is available rather than requiring you to accept a voucher.
10. Operational changes
Boat events depend on weather, sea conditions, harbour restrictions, vessel availability, safety requirements and other operational factors. The Event Provider may make reasonable changes to the route, schedule, vessel, swim stop, entertainment, food, activities or other operational elements where necessary because of weather, safety, instructions from the captain or authorities, availability or circumstances outside reasonable control.
Optional water activities are particularly dependent on sea conditions, weather and third-party operator availability. A minor operational change that does not materially alter the overall event does not automatically entitle a customer to a refund.
Where a material change gives rise to rights under applicable consumer law, those rights remain unaffected.
11. Arrival and transport
You are responsible for arriving at the meeting point shown on your booking confirmation by the stated meeting time. Transport connected with the event may need to leave promptly. We cannot guarantee that a late customer will be able to join the group after departure.
Always check your booking confirmation and event page before travelling to the meeting point.
12. Behaviour and safety
Guests must follow reasonable safety instructions from the Event Provider, captain, crew, transport providers and activity providers.
A guest may be refused boarding or removed from an activity where their behaviour creates a safety risk, is threatening or abusive, seriously disrupts the event or breaches lawful instructions. The availability of alcohol does not remove a guest’s responsibility to behave safely and responsibly.
Where participation is refused because of serious misconduct or a safety issue caused by the guest, a refund may not be available to the extent permitted by law.
13. Swimming and water activities
Swimming, banana boat rides, jet skiing, parasailing and other water activities involve inherent risks. Participation may be subject to weather conditions, safety requirements, age or health restrictions and instructions from the relevant operator.
Optional paid water sports may be provided by independent third-party operators. Customers must decide whether they are physically capable of participating and must disclose information to the relevant activity provider where reasonably required for safety.
Nothing in these Terms excludes liability that cannot legally be excluded.
14. Personal belongings
You are responsible for your personal belongings during the event. CMC is not responsible for lost, stolen or damaged personal property except where loss results from a matter for which liability cannot legally be excluded.
15. Reviews and user content
The website may allow customers to submit reviews, photographs or videos. You must only upload content that you are entitled to share and that does not unlawfully infringe another person’s rights or privacy.
By voluntarily submitting content for publication on the website, you give us permission to host, display and reproduce that content for the purposes of operating and promoting the Bottoms Up website and events. You retain ownership of your original content.
We may remove content that is unlawful, abusive, irrelevant, misleading or otherwise inappropriate for the website.
16. Website content and acceptable use
Website content, branding, text, graphics and other original materials are protected by applicable intellectual-property laws. You may use the website for personal purposes relating to viewing information and making bookings.
You must not copy, republish, commercially exploit, interfere with or attempt to compromise the website or its systems without permission, or use the website in a way that is unlawful or infringes another person’s rights.
17. Third-party services
The website contains links to services operated by other companies, including payment providers, WhatsApp, Facebook, Google Maps and other external sites. Those services are controlled by their respective providers and may have their own terms and privacy policies.
We are not responsible for the operation of an unrelated third-party website merely because we link to it.
18. Responsibility of CMC and the Event Provider
CMC is responsible for the website, online sales and booking services it directly provides. The Event Provider is responsible for operating and delivering the boat party.
CMC is not responsible for an act or omission of an independent boat, transport or water-sports provider merely because the service was advertised as part of the event, except where applicable law makes CMC responsible or where the loss arises from CMC’s own breach.
Nothing in these Terms excludes or limits liability for fraud, fraudulent misrepresentation, death or personal injury where such liability cannot lawfully be excluded, or any other liability or consumer right that applicable law prohibits us from excluding.
19. Events outside reasonable control
Neither CMC nor the Event Provider will be treated as having breached these Terms merely because an event is affected by circumstances reasonably outside their control, such as dangerous weather, sea conditions, port restrictions, government or authority directions, serious mechanical problems, emergencies or other comparable circumstances.
This does not remove any refund or other mandatory rights that apply when the booked service is cancelled.
20. Privacy and cookies
Use of personal information is governed by Part 1, our Privacy Policy. The website’s use of cookies and similar technologies is explained in Part 3, our Cookie Policy.
21. Consumer rights and applicable law
These Terms are intended to operate consistently with the mandatory consumer protections applicable to customers purchasing a leisure event taking place in Gran Canaria, Spain.
These Terms are governed by Spanish law insofar as they relate to ticket and event services performed in Gran Canaria, without depriving a consumer of any mandatory protection available under the law that applies to them.
Nothing in these Terms requires a consumer to waive a court, jurisdiction, remedy or statutory protection that cannot legally be waived. The mandatory rules applicable to consumer disputes will determine where legal proceedings may be brought.
22. Severability
If part of these Terms is found to be unlawful or unenforceable, the remaining provisions will continue to apply to the extent permitted by law.
23. Changes to these Terms
We may update these Terms from time to time. The version applying to your booking will normally be the version in effect when your booking was made, unless a change is required by law or is otherwise agreed with you.
