Cancellation & Refund Policy
This Policy applies to Bottoms Up Gay Boat Party bookings made through bottomsupgayboatparty.com unless different cancellation terms are clearly stated for a specific event. It forms part of the Terms & Conditions in Part 2.
1. Cancellations by You
72-hour rule
If you need to cancel your booking, please tell us at least 72 hours before the scheduled event. This gives the Event Provider a reasonable opportunity to re-fill the spaces.
1.1 Cancelling 72 hours or more before the event
If you cancel at least 72 hours before the scheduled event, the reservation payment or deposit is not normally refunded in cash. Instead, you may receive a credit or coupon for a future Bottoms Up event.
A future-event credit may be used toward another Bottoms Up event, subject to availability and the terms stated when the credit is issued.
1.2 Cancelling less than 72 hours before the event
If you cancel less than 72 hours before the scheduled event, you will normally lose the reservation payment or deposit and will not receive a refund or future-event credit.
1.3 No-shows and late arrival
If you do not attend, arrive too late to join the event or otherwise miss the departure, this will normally be treated as a late cancellation and the reservation payment or deposit will be forfeited.
1.4 Exceptional circumstances
If you have been affected by exceptional circumstances genuinely outside your control, you may provide full details when requesting cancellation. The Event Provider may consider the circumstances on a case-by-case basis.
Consideration of an exceptional request does not create an automatic entitlement to a cash refund, credit or transfer unless applicable law requires one.
1.5 Booking Date Changes and Duplicate Bookings
If you’ve accidentally booked the wrong date or would like to attend a different event, please contact us before making another booking.
We can usually transfer your existing reservation to another available date, subject to availability and any applicable price difference, without requiring you to cancel and book again.
If you make a new booking and subsequently request cancellation of your original booking, our standard cancellation terms will apply.
Where we agree to issue a refund for the original booking, any non-refundable payment processing fees charged by Stripe on that transaction will be deducted from the refund amount.
The deduction will reflect the actual non-refundable processing fees charged by Stripe for the original payment, which may vary depending on the payment method and Stripe’s applicable rates at the time of the transaction.
This does not affect your statutory consumer rights or your entitlement to a full refund if we cancel your event.
1.6 How to cancel
To request a cancellation, contact us as soon as possible using one of the following methods:
- Email: [email protected]
- Website contact form: bottomsupgayboatparty.com/contact-us/
Your cancellation request should include the name used for the booking, the booking or order number if available, the event date and enough information for us to locate the reservation.
2. Cancellations by Us
For the purposes of this section, โcancellation by usโ includes a full cancellation of the booked event by CMC and/or the Event Provider.
2.1 If the event is cancelled
If the booked event is cancelled by us or by the Event Provider, you will not be required to accept a future-event credit instead of a refund.
We may offer you the option to transfer your booking to another available Bottoms Up event. If you choose an alternative event, your booking will be moved accordingly. If you cannot attend or do not wish to accept the alternative offered, the amount paid to us for the cancelled booking will be refunded.
2.2 Weather, sea conditions and safety
Boat events are dependent on weather, sea conditions, harbour restrictions, vessel availability, instructions from the captain or authorities and other safety or operational considerations. If any of these circumstances require the Event Provider to cancel the entire event, the cancellation will be treated under section 2.1 above.
2.3 Operational changes that are not a cancellation
A change to the route, vessel, swim stop, entertainment, timing, food, activity availability or another operational detail does not necessarily amount to cancellation of the entire event.
Where a change is minor and the event can still substantially be provided, it will normally be treated as an operational change rather than a cancellation. Where a change is material and gives rise to consumer rights under applicable law, those rights remain unaffected.
2.4 Separate travel and accommodation costs
Unless applicable law requires otherwise, a refund for a cancelled Bottoms Up event is limited to amounts paid to us for the affected booking. We are not responsible for separate costs such as flights, accommodation, taxis or other travel arrangements that you booked independently.
3. How Refunds Are Processed
Where a cash refund is due or has been agreed:
- the refund will normally be returned using the same payment method used for the original transaction, where possible;
- we aim to process the refund within three working days after the refund is confirmed;
- after we process the refund, your bank, card provider or payment service may take additional time to make the funds available; and
- the time taken by a financial institution to post the refund is outside our control.
If an event has been cancelled by us and you have not received confirmation of the refund or alternative arrangements within three working days, please contact [email protected].
4. Deposits and outstanding balances
Some Bottoms Up bookings require a reservation payment or deposit online, with a remaining balance payable later. The cancellation rules above apply to the amount paid to us at the time of cancellation.
Where a customer cancellation results in forfeiture of the deposit, an unpaid future balance is not normally charged unless different terms were expressly agreed for the specific booking.
5. Credits and transferred bookings
Where a future-event credit or transfer is issued following a customer cancellation, it has no cash value and is not itself a cash refund. It may be used only in accordance with the terms stated when issued and is subject to event availability.
If a transferred event has a different price, any additional amount or adjustment will be explained before the transfer is completed.
6. Mandatory consumer rights
Nothing in this Cancellation & Refund Policy limits any refund, cancellation or other consumer right that cannot legally be excluded under applicable law.
